False case registered against me and my family

Question

My wife filed false cases against me and my family. I am living in Australia however my family is living in Guwahati. my wife is also an NRI and only to harass my family she has filed a complaint in Darjeeling showing herself to be resident of Darjeeling. after marriage we both never stayed with my parents and my parents have also not visited us in australia. but the police in darjeeling is behind my parents to arrest them and they are calling them to come to darjeeling for mediation. what can we do to come out of it?

    A case can be transferred under provisions of law, but it should be shown that the trail within the chosen form can lead to denial of justice. The section 24 of civil procedure code will override sec 21 of hindu marriage act and sec 24 of civil procedure court alone will govern the power of the court to withdraw and transfer matrimonial cases pending on the file of different courts.

    As u said that your wife filed a complaint and your parents have been  called by darzling police for mediation it means that no FIR has been registered till date against you n and your parents. Your parents  should appeared  before the darzling police and apprise them about the real facts of the case.  If you are  apprehension that they will be arrested by the police then they can seek  protection  from the court b filing appropriate petition in the court  by stating that they are ready to appear before the authority by police  be directed not to arrest us without seven days prior notice.  Fir further details you can personally  approach the insta legal team
