I recently joined the company ‘A’ on March 10th, 2020 and received offer letter and appointment letter respectively. There are 20 individuals in our batch who were serving the probation training period but was scrapped owing to COVID-19. All of us received the message of the batch being scrapped due to the pandemic and subsequently were submitted resignation letters. Can we seek legal action against the company’s action?
Yes you all can seek legal action against the Employer because the reason given to you all is the scrapping of your engagement due to COVID and the government has already issued directions to the employers not to lay off because of the unforseen circumstances. A legal notice is to be issued immediately via email or other available modes for the action of termination by the employer.
