Can a RWA using government memo block entry to my aprtment for domestic help.

Question

stay as a tenant of a apartment complex in Hyderabad. The apartment resident welfare association has started behaving dictatorially during the pandemic and has started implementing draconian measures under the pretext of resident welfare. The government vide memo from principal secretary municipal administration has allowed RWAs to take a call on the issue of permission of allowing domestic maids in society. My question here is , can government delegate such powers to such associations especially in a scenario where this directly impacts my rights and liberties. Can a PIL be filed on this?

    Usually such delegation is not permissible. Firstly, is your RWA registered? is yes, then it is the cooperative societies registrar or the registrar under whom your society RWA is registered are those who can delegate the power by issuing appropriate orders. the RWA for the welfare of the society can take decisions however if they are not allowing the maid for you, they must not be allowing it for anyone else in the society. it is advisable to speak to other residents of the society to know if they are ready to support you in this cause and if you find that there is a major number of people who are suffering from such orders passed by the RWA (assuming that your area doesnt fall under the red zone) then a PIL can be filed.
