NRI Property Related Case.

Question

Dear Sir                ,

 

  1. We 3 brothers have a common land in Uttarakhand for sale.
  2. Two brothers live in USA and they have sent their Power of Attorney in my favour attested by the consulate General of India in San Francisco.
  3. But our advocate says my brothers will have to come India once within 6 months of Registry of the land.
  4. Please advice the correct method.

    If the SPOA or the sale through SPOA has any condition mentioned whereby it is made mandatory for the NRI to visit India, in such case the suggestion of Advocate may be relevant however there is no requirement for the NRI to come to India within 6 months of sale through POA. The reason why POA is executed is because the seller cannot be present physically and hence the authority is delegated to another relative.
