NCR signed Statement

Question

Torture from my in-laws and wife. Everytime my in-laws come to my home and take my wife with them without my consent. Even though I disagree, they’ll threaten me and take her away from me and ask me to go and pick her back after 2 or 3 days… Last time they created a huge fight with us and abused us on the streets and took my wife with them. I stay with my mom, younger brother and wife.. now it’s been 2 months they took her with them and now filed a complaint (NCR) against me, like I’m not at all bothered about my wife, I didn’t go and bring my wife back etc etc…my mother is aged and she’s becoming weaker and weaker looking at these incidents happening at our home.. The police were not at all ready to listen to our problems and asked me to bring back my wife with me… I asked for a week of time and signed the statement. Now I want to extend the given time for atleast 2 months minimum, so that I complete 1 year of my marriage, I want to file for divorce at any means and get rid of her. Please give me suggestions on how to extend the time requested as per NCR.

  1. If you file a contested divorce petition, you need not wait for one year. The one year minimum separation or completion in marriage is required for the purpose of filling a mutual divorce.
    It is advisable to send her a legal notice showing your intention for divorce. This time when the inlaws come to your place and create a ruckus, call the police and lodge a complaint. Further, you can inform the police regarding your intention to file a divorce case and therefore you are not willing to get her back. In the situation, the police files an FIR, seek yourself and all other persons named in the FIR, bail and then fight out the case legally.
    If your mother is aged, she can file a domestic violence complaint against the daughter in law under protection of women from domestic violence act and can simultaneously approach senior citizen cell in police station and lodge complaint against your wife for domestic violence by her.
