Question

I have taken a loan on my wife name and whose EMIs are paid by my wife. I had some losses in COVID so she is paying the EMIs. We both are working. Due to compatibility and daily personal issues, I want to take divorce. We have been together since 3.5 years. I want to take mutual divorce. My primary concern is related to loan amount. Do I need to pay the loan amount to her or not? It was taken with her consent. or if yes, then Will I have to pay everything before taking divorce or can pay in EMIs as mutually agreed?

    If you both are agreeing to a mutual consent divorce then the payment of EMI can be settled between you amicably. either you both can agree that you will pay lumpsum to her to enable her to pay from her account and refund the earlier paid amount or you can continue depositing in her account, the amount of EMI which is to be deducted. That is totally dependent on the terms agreed between you both.
