Query regarding forensic DNA medical report in delay intimate case
Question
Is there any judgement case ( related to “sex on promise of marriage “) in which forensic medical report have got success in identifying sperm from vaginal cavity in situation where victim reported to cops after long duration of time ( for ex- 3 months or more since last relationship ) ? Is there any such case after implementation of new medical forensic guidelines (introduced in 2018 by ministry of home affairs & CFSL Chandigarh) till now ?
Answer ( 1 )
No, there isn’t any reported Indian court case—before or after the 2018 MHA/CFSL Chandigarh guidelines—where forensic reports successfully identified sperm in vaginal swabs taken three months or more after the last intercourse, in a “sex on promise of marriage” scenario. In fact, forensic science uniformly indicates that sperm degrades rapidly after ejaculation—typically within a few days. The 2018 National Guidelines on Medical Forensic Care underline the importance of prompt evidence collection precisely because DNA or sperm detection is unlikely after a long delay. To date, there is no precedent where sperm evidence detected after such a delay has been upheld by the courts.
