Seller is denying to sell the property after agreement to sell

Question

I got into sell to agreement with a party where the property. Now, seller is denying to get into sale deed and saying that they got another party with higher offer.

  1. If you have already paid the earnest money then you are advised to file a suit for specific performance insisting the seller to finish the sale deed. however if no earnest money was paid then the seller has the right to sell at higher price.
