annulment of marriage under muslim law
Question
I was married under muslim personal law 8 months ago. I am an EX muslim girl and have obtained an affidavit from a senior lawyer several months prior to the marriage stating that i am no longer a follower of islam. unfortunately, the marriage was conducted in islamic way (meaning i was not present), as i was led to believe there would follow a legal ceremony. it was later registered because i had signed a legal document on that day, but i only lived for 2 weeks with my partner and we never consummated the marriage in that time
In this case, can i get an annulment instead of a divorce? the guy was aware that i am not a muslim, and i can prove the non consummation as I am a virgin. i moved out of india for work, so I’d also like advice on whether I can hire a lawyer online to proceed with this. Thanks in advanc

Under Muslim law, there is no provision of annulment as the marriage is a contract only and not a sacred bond unlike Hindu Law henceforth, if the marriage was not valid as per the Muslim law, it is not annulled but becomes void and can be declared so by the court.

As such senior lawyer does not have any authority to grant any stated certificate or affidavit and if any lawyer has given then such certificate and affidavit has no legal validity. Since marriage is performed and registered under islamic law hence marriage is performed as islamic marriage. Under islamic law there is no provision of annulment of marriage, however, you can opt for KHULLA in terms of islamic law and can also file declaratory and injunction suit declaring the marriage void if grounds so exist.
