Builder trespassing into community and occupying several parking spaces and conference hall after hand over for his expansion plans
Question
Our apartment community houses a lot of high raise From A to E. After the registration and after the E block was completed, the builder decided to build another black which was not part of the plan also successfully sold all the apartments. Now 7 years later, he has still not handed over the clubhouse or parking buildings to the association. Recently he has acquired the piece of land next to our community and has take the association core committee on his side, and started construction work on the new site which will be built a few new blocks to be integrated to our apartment community, sharing the clubbouse and all other common amenities. The builders have forcefully taken hold my parking space to use it as access / marketing / sales office. I have not given any written consent. The Core committee members and the by laws were created by the builder and his supportive group and the security not the association care takers are responding to our request to give our car park back.
Could you please suggest what action I can take to prevent this?

If a registered welfare association has been already created then file an application before the District Registrar where the RWA is registered seeking direction to the builder to handover the possession as RWA is already formed. The bye laws of the RWA etc will govern the field. the RWA should issue a notice to builder for handing over whatever has been left.
