You can buy however the vacant possession will have to be demanded in accordance with law. firstly when the property is auctioned and purchased by you, a legal notice would have to be sent to them aprising the person residing in the house regarding change in ownership. if they dont vacate, legal recourse would be required to be sought through filing of a Suit in the District Court.
