Question

My ancestors were from “kaibarttya” community which belongs to SC accordingly a land chita copy document of 1905-06.After him every son wrote “Keot” which is General community.So Charpanch not give us certificate of SC as in category is changed.Also we haven’t any proof other than that land document.But now that original copy has lost by officials in register office can’t be found.We have affidavit and a copy of that old chita copy states we belong to SC.But Charpanch ask us to file a case to get the SC tag back.Is possible anyhow please advise.

    If since a long time the name of the community has been changed, it will be difficult to prove as to what ensued for which the change was permitted at that time. There is a huge difference between SC and General community. To change back to the old community, the practice followed by your community will have to be shown to be followed by SC community and not general community. the practices followed would have to proved befor the court by leading evidence and only then the court would be able to decide accordingly.
