Collateral given for Education Loan is not getting sold during Auction by Bank
Question
I took an Education Loan for my ward to study abroad from a public sector bank in India. Since loan amount was more than 40 lakhs, I had to offer a collateral by way of Land. The said land offered as Collateral was obtained through a court order and has clear legal documents. But unfortunately, the Developer in whose project my land is situated has not developed the approach road or given any amenities plus has lots of legal cases against him for fraudulent transactions. So there are no buyers for this land in the outskirts of a major city and every time the bank tries to auction it the process fails. We paid the EMIs for 4 years post studies of my ward who returned to India after studies since there were no suitable jobs abroad. But since EMIs were huge it became difficult and the moment Loan became NPA, we agreed to auction of the land. Since there are no buyers, now court has filed legal case on us and is asking for huge one time settlement which is 90 percent of loan plus interest compounded for last 4 years along with penal interest. This is difficult to pay. So what are my options

Option would be to sell some other property belonging to you or file a case against the builder if you have no other property for refund of your amount or harassment due to deficiency in service.so whatever money you are able to get from the builder through the consumer forum, pay for the disbursement of loan.
