Cowned property when couples get seperated
Question
Me and my husband have some differences and we are staying seperate. Neither I want to get back with him nor divorce him legally. We had bought a flat which is registered in both oir names. But all the money paid by me. How can I get it back .. Currently the orginals are in the bank. I want it to belong only to me and not to him anymore.
Also my worry is if I die and he gets married again, will this property go to his new wife and kids. Will my kids loose it, if I dobt do anything as of now.

Since the flat is registered in the joint names of you and your husband, the husband has equal share in the same irrespective of the fact regarding the payment made by you. If you die, your children will get your share as well as they are entitled from the share of your husband as well. It is advisable to get the property transferred on your name alone or he may sign a relinquishment deed giving up his rights in the said property since the payment for the said property has been made by you. If this doesnt settle amicably, you need to give details of your current situation with your husband for proper guidance. You may contact the team at Instalegal directly for the same via Consultation call or whatsapp.
