Deceased claim

Question

I am the only offspring of my parent. My father died 3 years back leaving a saving account and fixed deposit. He had given my name as a nominee in FD but not in saving account. Before dying he had transferred whole amount of FD to saving account. Can I claim amount of both saving account and FD as a nominee in FD?

  1. No you cannot claim the saving account money if you are not the nominee. The nominee can access the account and the legal heirs (including nominee if he/she is a legal heir) can base their claim over the amount in case no WILL or gift etc has been made by your father. If the mother is the nominee then she can get the amount transferred to her account and the same can be divided between you and the mother.
