Early Relieving Issue/ Notice Period Related

Question

Dear Sir/Mam,
I had applied for Separation due Work Life Balance Issue but my reporting manager decline to accept the resignation and said if you have or provide offer Lee then I’ll relieve you early. But when I asked him regarding the same after offer Letter. He told me to serve full notice period of 90 days. Now I have asked for early Relieving from RSM, NSM and also from Zonal HR. They are declining but as per my Contract there is option for Buyout As stated in Contract “Your employment may be terminated / is terminable by either party by giving to the other, three
month’s notice in advance or by paying to the other, salary in lieu thereof for shortfall in notice
period” written. I also mailed for Buyout option,Still no early Relieving confirmation is given. Kindly guide me what I can do for early Relieving.

Answer ( 1 )

  1. If there is option of buy out, it is at the discretion of the employer However if you are not assigned any pending work or any project which is having deadline, you must follow up with your manager and HR for early reliving. Since your resignation has not been accepted, your notice time has also not begun. In the circumstances, no response is received, you can inform them again of your intention for buy out and give an appropriate fixed dated stating therein that after this date you would not be appearing for work at the office.
