Feasibility of Divorce in less than a Year of marriage
Question
I got married 2 months ago and there have been irreconcilable differences that have arisen between both of us. We have therefore decided to file for divorce through mutual agreement. Is maintenance mandatory considering both of us are in established careers?
No maintenance is not necessary. In mutual consent divorce, the terms and conditions on which the mutual divorce is being sought is to be settled by both the consenting parties and hence if you wish not to claim any maintenance or alimony, mention the same in clear words in the settlement agreement between the parties which will form the basis of the divorce being granted by the Court. Further, the application before one year is not permitted hence you would have to wait until a year before filing a case for divorce.
