Friend trying to steal property

Question

There is a flat in the name of my mother and me. A friend wanted to purchase the flat from me and I agreed to sell and signed an agreement to sale and told him that I will ask my mother to come and sign when he pays the full amount. He didn’t pay and instead lived there. I didn’t mind as he paid me rent. Then he stopped paying rent due to financial difficulty. I said he can live for free till I need it for personal use. But now I need the property . He is claiming I sold him the property and is not leaving. What to do?

    Is the sale deed registered?
    If not file a rent petition before the rent controller on the ground that the rent has not been paid and that the sale agreement fell out since he denied to purchase the property as he was in financial crunch. If you have received any lumpsum amount through online mode, that can be adjusted if he is ready to buy the property at the prevailing market price. If your mother has not signed on the sale deed, it is most likely that the sale was not registered.
