Grandfather ancestor land was given by gift deed to my relative

Question

Actually the property land was my grandfather’s. But after my grandfather’s death, my father was given gift deed (may be forcefully or by pressure from my relative) to my relative without children concern. Now, my father had passed away. I read in some legal forum that, if there is no will from my grand father or my father.. this land property rights goes to grand children by default. In this case, as a grand-son, can I file the case against my relative about the forceful gift deed from my father. Please suggest, can I file case in this scenario. Thanks in advance.

  1. If the property was ancestral, the same cannot be given as a gift to anyone. you have a right in the ancestral property by birth and therefore you can challenge the gift deed and claim your share from the same.
