How do I get my house/society out of the “slum area consideration” to avoid any future demolishing for redevelopment?
Question
My house is a part of a housing society. We’ve been living here since generations. Decades ago this property was bought by a couple of society members from a private owner of the land and they created row houses. Although I was told our society comes under slum area and any construction above 14ft is illegal and unauthorized. We are not encroaching on land. All the houses are well made with 24/7 electricity, running water, etc etc facilities. How do I get my house/society out of the “slum area consideration” to avoid any future demolishing for redevelopment?
- Are there any legal documents or proofs needed?
- Is there any registration for something like this?
- What criteria does our society need to meet?
- Are there are laws I can read regarding this or maps I can refer to?

As I understand your area is covered under the scheme floated for redevelopment of slum area. If your area is coming under slum area consideration, ur society will be required to approach the concerned municipal corporation with a representation for declaring the area as not under slum area consideration. If no positive answer is received, either file a civil suit for declaration or a writ in the respective high court showing why the area is no more a slum area as defined under the Act. The stay granted by the court, if any, would be further helpful in establishing your claim.
