Husband counterfiles Divorce case against 498a case
Question
I have been married for about 5 years and have a three-year daughter. I filed 498a case on my husband which has not come yet for the hearing. In the meantime, my husband has filed divorce. I have been asked to file counter. Can I delay divorce proceedings if I don’t file counter and just state about the criminal case?
No it is not advisable not to file your counter. you may buy as much time as the Court feels permissible however please keep in mind that usually the court doesnt give much time rather they will refer your case to mediation. once the case goes to mediation, you can stretch not filling the reply till mediation is going on or the criminal case proceeds a little further.
If at all nothing works out then in that case, give a detailed reply of the divorce petition citing the entire details mentioned by you in your 498A case.
