I and my wife have been staying separately for over 3 years now. Upon my Retirement, I gave her more than 50 Lakh with which she bought a flat in her hometown. In addition, I give her half of my pension. There are no bounding child custody issues as the children are adults. I am seeking a divorce from wife to marry someone that belongs to my community. We are seeking a divorce by mutual consent and continue to give her 70% of my monthly pension. 1 Can I ensure that my wife receives the family pension after my death I also want her to avail of the army family pension after my death? 2 Can I in any way ensure a smooth legal arrangement for a future wife to give ex-wife after my death so that it facilitates the Mutual divorce procedure?

Any arrangement for the ex-wife can be made by you by way of the a WILL duly registered but any arrangement with the army authorities as regards the first wife can be left the same if you do not intimate and get the records changed as regards the particulars of the second wife. in case you do not put in the papers that she is not your legally wedded wife anymore, the army authorities will not change in the record and hence your ex-wife will be able to get the pension and the medical benefits as you desire.

Best way to secure the future of your  first wife make a registered will in favour of your firstwife and whatever u want to give her mention the same in the will. After taking the divorce from your first wife you have to inform army authority and they would enter the  name of your second wife in records nd thereafter she would only entitled for all retirements benefits or family pension. If  you did not disclose them then it creates problems between your first wife and second wife. Better option to create a will in favour g your first wife before taking the divorce
