I received a legal notice from my contractor after i asked him to exit the contract, can i apply for caveat to proceed with my construction before my contractor files a case in court

Question

I have made a contract with builder to construct my house, after 5 months of work he completed the pillar stage, he never followed the quality products and never done any supervision on the site, i am very unhappy with his approach and i sent a letter with all his mistakes and asked him to cancel the agreement before the 2nd payment due time, he sent a legal notice and demanding for 60 lacks to pay with all false allegations, I approached a lawyer and sent a reply to legal notice.
At this point can i apply for a caveat and proceed with my construction, before they file case in the court ?

    Let the contractor file a case if any for refund or damages as has been asked.
    You are not stopped legally for not proceeding with the construction as required. If the Contractor files a case and a notice/summons are issued for appearance, then conduct the case accordingly.
