Maintenance to a divorced wife by ex-husband

Question

I have been divorced by my husband in 2018 but i am not remarried also. he has got married after the divorce. divorce was granted on my consent before the court and no money was given by husband after divorce. I am not able to take care of myself and in acute shortage of funds. can i still claim maintenance from my ex-husband?

    Even if you are divorced, as per law you are still entitled to claim maintenance from your husband if you have not remarried. A Petition under section 125 crpc can be filed before the Court claiming maintenance if you are not able to sustain yourself. The Supreme Court has held that if the divorced wife has not remarried and is not able to maintain herself then in that scenario, on showing proof, the husband can be directed to pay a fixed monthly maintenance to the ex-wife (inclusive of a divorced wife of any age).
