My Grand son’s custody

Question

I am a 78 years old man and my wife is 71 years old. Our daughter has expired two years back and her husband got married again. Recently he has dumped his 14 years old son to our house with all his belongings and not taking his son since one month. It’s not possible for us to tackle our grand son in this age as he is a hyper active child and is under medication since a long. Sometimes hebecimes very arrogant. Now kindly suggest if we can take any legal step to make his father bound to take his son’s responsibility.

  1. As per law the guardianship of child above the age of 5 years vest with father who is also natural guardian of child. You are neither legally nor morally liable to look after and maintain the child. You can approach guardian court making father as party in the case and can seek to appoint him as guardian or to keep the child in destitute home or in special child school and also to maintain and pay the fee required to maintain the child.

  2. As per law, the father is the natural guardian. You can file a petition in the court through the son seeking maintenance from the father and in those proceedings, you can request the father to establish his son. Legally, you are also guardian of the grandson however if he is misbehaving, either you can report his behaviour to the police and get him sent to correctional home (which may make the child more aggressive). or you can take corrective measures by taking the child to some psychiatrist to understand the anger inside him.
