my uncle purchased one house in his son’s name with his life savings and some loan. as the loan has to be on an income basis .so his son’s income was shown. so his son suggested to take home with his name. he agreed as the loan was important and there was no dispute in house. but after the marriage of his both sons. condition is bad, the elder son started fighting. and now his expenses are managed by his younger son. what Does he do so his elder son can not force his younger son to leave the house after him.

The father can get the property transferred from the name of the elder son to his own name stating that at the relevant time the loan was to be taken so it was registered in his name. The elder son can make a Gift in favour of his father with regard to the same.
The father can also file a complaint if he is a senior citizen under the provisions of Senior Citizen Act for evicting the elder son from the property because of the harassment being caused to him. Simultaneously a civil suit for declaration to declare the father to be the owner of the property as the same was purchased from his life savings at that time can also be filed.
