PSU cancelled call letter because degree not elgible
Question
This is issue with central government PSU.
So my friend’s graduation is in Electrical and Electronics engineering .
This particular PSU has given a notification for recuritment of Management trainee and in the eligibility criteria it has mentioned that1. ” engineering graduate in electrical disciple”
2.Allied branches or courses are not allowed.
He has applied for examination , during application they didn’t asked any documents .
He got selected for interview and call letter issued and later he has sent them degree certificate and other documents.
Two days before interview ,the Company has sent an email that his degree is allied degree and his interview call letter is cancelled.
My question are 1.As per the notification engineering graduate in electrical disciple are required, so we don’t have any source or even in that notification they didn’t mentioned anything regarding which branches are allowed
2.There is no notification from AiCTE or any body that states that EEE is allied branch,we have just one pdf from aicte which states what are allied and not allied ,but it is not notification or gazette.
My friend thought EEE is not allied branch and as per point 1 he thought EEE is electrical disciple and applied for the post
Since the company also don’t have any solid proof to distinguish between allied branch and non allied ,can we file a case against this and what are possible expections we can have

If its a company document giving guidelines as regards the allied and non-allied, your friend had to check and see if his course falls under allied courses or not. If it is specially mentioned that his course would fall under the allied courses, then the PSU has a good chance of wining the case because it is the prerogative of the employer to lay down guidelines which are administrative in nature and court usually will not disturb until it can be shown to be arbitrary or discriminatory. In your factual scenario, the action seems to be valid and backed by law. However you can still make a representation and on failure of the same, try your luck before the High Court with the direction to the PSU to clarify the meaning of electrical discipline.
