Reg. Payout in case of Liaision Office Closure

Question

I worked 11 Years for Liaision Office based in Noida (UP) of a Hong Kong registered company, which indeed is a subsidiary of a French Retail group.Group has put HK co. in voluntary liquidation, without any clarity on our future, we just rec’d a communication from country manager in India to submit our debt claim form to liquidators through the country manager and we will be kept informed by 9 to 12 Months!I’m afraid the company will close its liaision office in India too and then all will be lost.. as company has not paid any gratuity, notice period, severance pay or even PF or TDS not deposited for previous months and not giving any update about it or our employment..

Issue a legal notice to the administrator who is looking after the entire winding up process. you also need to address it to the main company keeping in loop the branch office as well. If they dont pay up, file a suit in the court where the liaison office is established. Simultaneously make a complaint to the registrar of the companies against the company having branch office registered in india.
