The answer to this question would depend on the rules and bye-laws of the society and the terms of the agreement entered between the parties. Since the same have not been shared, the following answer is being provided assuming that the bye-laws do not make any provision as regards the situation mentioned.
Once the bye-laws is silent regarding the appointment and disqualification of the builder, any procedure can be adopted in a special general meeting held specifically for that purpose and with the concurrence of the majority, the decision can be taken.
