Sale agreement query

My brother has agreed to sale his flat to the existing tenant and has received 50% of the sale agreement amount to his bank account.initially it was agreed that the both husband and wife (tenant side ) will be contributing to the total cost and accordingly agreement of sale will contain both names.Therefore,wife has transferred her share of money contribution to my brother but the husband is asking to have the agreement just in his name without wife consent.
what is the best way to avoid any issue while doing final registration?

If the wife name is to be excluded without her knowledge, it will amount to fraud and you can even be booked by her under criminal offence of fraud and cheating. Once the complaint would be made then the husband would not be liable for the act committed in connivance with him as your brother has received the money from wife and not from the husband, So it is highly advised not to do such a big blunder.
