WIFE ADVOCATE ASKING FOR COMPROMISE
Question
My court case is going on since April 2021.I filed annulment on my wife for hiding her affair before marriage and continuing even after marriage. Im physically disabled wears calipers. My wife filed counter making all false allegations that i have not informed that i wear calipers and she came to know only after marriage. In turn I filed rejoinder denying all her allegations. I have marriage photos as proofs where my callipers are clearly visible. She was happy after marriage for 1month but when i revealed her affair she is making false allegations that she was not aware of my disability and she left me. At present it is at evidence stage. My wife advocate asking me for compromise for mutual consent with 5lakhs alimony. I told her that if u want divorce u can take but I will not give any money .Then her advocate asked me that why I have filed annulment if I don’t want divorce. Then i replied to her that after 2months of marriage she left me and refused to consummate with me and always chatting and meeting with her boyfriend even after marriage and I called her to come back but she asked divorce so i felt that she cheated me so filed annulment .I never asked divorce so why should i give alimony. Her advocate replied that her boyfriend married other girl. I told her that if my wife is ready to live with me i will withdraw case but if she wants divorce she can take but i told her that I will not give any alimony. Then my wife advocate asked her whether she is ready to live with me but my wife told she dont like me. Now If i continue with case can i win annulment based on her WhatsApp love chats before and after marriage? and also if i show my marriage photos where my calipers are clearly visible will judge give favour me?

Unless the evidence is perused, it is difficult to say regarding your chances to win or loose the case however if you annulment is allowed then chances of you not ot pay alimony are higher however in a divorce case, alimony will be decided by the court if the wife files an application for grant of permanent alimony.
