However it was 2018 decision in the case of Joseph Shine versus Union of India that the adultery was declared unconstitutional however in 2016 itself, it was opined by Supreme Court that Extra-marital affair is not a criminal offence as held in the case of K.V. Prakash Babu versus State of Karnataka and falls short for the offence of abetment of suicide as well as Section 498A Indian Penal Code.
