Booked a flat with builder, need my pre-booking amount back

My father booked a penthouse-flat with a known and reputed builder in our area. The booking was made at the pre-launch time and on the basis of brochure shown to my father, he deposited 21 lakh. he was informed that as soon as launch happens, he will get the receipt and an sale agreement will be signed. this happened in June, 2019. the builder is yet to launch the project and whenever we are asking about the receipt for the payment, he is evading the question. no agreement has taken place till now. my father wants the money returned. we only have the brochure that was given to us but the amount was half paid in cash and half through NEFT. kindly suggest how to get the money returned from this builder.

    U can approach to the  consumer court or rera authority for refund of payment made by you. As  you said you have paid half of the amount in  cash.  It is difficult to prove this  without any documentary  proof.  But it can  be proved by way of other evidence. For further discussion you have to approach the insta legal team

    Even if no builder buyer agreement was signed you are still entitled to cancelling a booking and claiming refund in the absence of the signed contract or agreement holding on the allotment letter and receipt of payment is important. You can file a case in consumer court and RERA(real estate regulatory authority) .b. but you need to have record of the transaction. It’s a must to have acknowledgment document.
