Grandparent flat to my name

Question

Grandmother had 5 flats. Out of this 4 she gifted to her children and kept 1 for herself. This she did in front of 1st class magistrate affidavit. Then she made a gift deed for one of my parents. Soon after my parent passed away without registering the gift deed. Now I want to transfer the flat given to my parent to my name. What to do? (Grandmother alive)

    If the Grandmother is alive and the Gift Deed is not registered, the flat cannot be transferred to your name as the gift deed is not valid unless registered. Further, it is her sole discretion to deal with the property as per her own choice. Since the person who was supposed to get the gift is not alive, once his right has not accrued, then the same cannot flow to you directly.
