Succession rights of relatives of childless Hindu widow

Question

We are all Hindus. My aunt expired recently in Oct 23.
Her husband and son expired a few years back earlier. She has couple of flats which she acquired by her own job earnings and some help from mother and brother. She had a caretaker who is nominee to her flat. Deceased husband has living brother and nephew.
Aunt has living sister and brother. We don’t think she has made will.
Please provide succession right details.

  1. Was the child unmarried? If not then the property would devolve on the grandchildren if any.
    in the event there is no husband, children or grandchildren then succession would go by the origin of the property. Any property begotten from husband’s or inlaws family would revert to the living heirs of the husband i.e. mother or brother, sister or their children etc. Same would go for the self acquired properties as well. However for properties inherited from her mother and father, that would go to legal heirs of the father.

      My aunt’s son was not married. Will self-acquired properties of aunt go to her deceased husband’s relatives first. Please clarify. Is this as per Hindu succession act.

      • Yes the self acquired properties will go to the legal heirs of the husband as per the Hindu Succession Act. The right to inheritance by the legal heir of the husband has primacy over the right of mother and father of the girl.
