Question

I bought a 125 sq yard plot from a RERA registered Builder Developer and turned out that the land does not belong to him and doesn’t have a CLU and RERA. Buy back agreement was signed accompanied by a security check . Now the builder claims he does not have money to honor the cheque. How to deal with this?

  1. This is a clear case of fraud, you can file a criminal case against him and since he did not have RERA approval, you can approach the consumer court seeking refund. Once both the remedies are taken together, the builder will have to pay up. There is no denial that he has not taken you  money but the security cheque can also be of no help because once the cheque is bounced, you will have to file a negotiable instrument complaint against him. To build pressure and to clear your intention to the builder that you will proceed legally if the amount is not refunded, a legal notice can also be sent to the builder giving him a time line to pay the amount or face litigation.
