Converting an entire residential flat into paying guest accomodation

Question

I’m residing in a large apartment having more than 700 flats in the sub-urb of chennai. Our past president of the welfare association had converted nearly 10 flats including one of his own flat in to paying guest accommodation. The flat owners made agreement with one of the tenant in the flat and have added the president name as caretaker in the agreement.

But, the president is collecting charges from the guest on per bed basis per month and paying the agreement amount to the flat owner. He have equipped the flats with beds and all furnitures to convert into pg/hostel set up. The maintenance charges also paid by the president from his own account.

Now, the new EC committee has planned to ban the PG accommodation in the residential complex and have also passed resolution during the election and AGM. Now, the president has removed the advertisement alone from the real estate broker websites, but still running the same pg set up without acknowleding it as PG.

This is creating a huge nuisance inside and the new team could not concentrate on any further develoopment due to this.

My question is, whether the above is permissible legally?
To my knowledge they don’t have licence to run this fully commercial PG set up and they are also not paying commercial EB.

How can we sort out this issue now legally and make a peaceful living?

    The PG is being run illegally inasmuch as special permission is required to run a PG as the government charges commercial rates of electricity for such kind of business.
