Question

I used to work with an MNC bank. 3 years ago I sold an insurance policy to a client explaining her everything about it. For 3 years she has been paying her premiums regularly. Now, suddenly she is claiming that I have done misselling of the policy by explaining her wrong details. She is complaining to lodge an FIR against me for the same. She is an old lady and as per banking process while selling the policy she has confirmed on email also.

Can you please help ?

    Yes if a true disclosure has been made by you then in that case, even if she lodges an FIR against you, the police will find the truth as all the details will be sought and she cannot file a complaint only against you however since you were acting as agent of the Bank while selling the policy, the bank is also severally and jointly liable for any misrepresentation if any could be proved.

    You explain to the lady clearly that since entire facts were explained by her and she had accepted it all by putting her acceptance, the bank or you are not liable. it is the buyer who needs to be aware in such cases.
