Non Compliance of UPRERA Order by builder
Question
I have booked 2 flats at Yamuna Expressway, G Noida. Due to delay we went to UPRERA for delay penalty. UPRERA ordered builder to pay delay penalty @MCLR+1% and deliver the completed flat as per brochure within 60 days. It has been more than 5 months since then, builder has not completed the flat. On the contrary, he is insisting for Maintenance from 19th May 2019, day on which he received OC. What should be my next course of action…

You can again approach to the UPRERA by filing an appropriate application for noncompliance of the order passed by the UPRERA against the builder. If he has not deliver the posssion of flat within time as directed by the UPRERA then its non compliance of the order. Secondly the builder has not delivered the possession so he cannot claim the maintenance from you. For this you can approach to the UPRERA or Consumer Forum.
