Sale of Defective Home Appliance

Question

I purchased an Electric Cooker from a local shop in Chandigarh a couple of weeks ago. But when I opened to use it it didn’t operate. I called the shop and he refused to exchange it exclaiming that the shop is not responsible. Rather I was insisted to contact the manufacturer for the concern. How can I raise a complaint in the consumer court and what proofs are required in support as per the law?

    Did you check the appliance before buying the same? If not, then the shopkeeper is not liable to sell you a defective good as well however you should also contact the Manufacturer saying that a defective good has been sold by their dealer. Since it would be in the warranty period, the Manufacturer will change the good for you otherwise, get issued a legal notice to the manufacturer as well as the shopkeeper.if still after receiving the legal notice, they dont respond or do not exchange your good or refund your money, then in the District Consumer Forum, a complaint would need to be filed attaching the bills etc and the communication as regards between you and shopkeeper as well as you and manufacturer. You can file the case in consumer forum yourself as well however it is advisable to seek a lawyer to take care of the complaint.
