Using domestic property as commercial

  • I want to know what can be done against the people who are using the domestic property as commercial property, as these people are creating nu sense in the street where I live.

    They cannot use it as commercial purposes if its falls under residential area. They have to take permission  from the municipal authority  and as per rules and regulations of the corporation act it cannot be granted. So you can move a complaint to municipal authority.  Secondly you can also file complaint with the electricity board for   not paying te electricity charges as per non domestic purpose.

    Thirdly you can file a civil suit and take saty against them for creating public nuesense  in the area without approval from municipal authorities

    Firstly it is to be seen if the commercial activity being carried out falls under the exemption list (if any) allowed by the government to run in the residential premises for example, a lawyer can have his office in the portion of his house, a doctor can also open a clinic in the portion of his house. hence if the activity being carried out by the person in your neighbour is such activity which cannot be allowed to be run in the residential premises then it is to be seen if the concerned person has taken any permission to use the residential premises for commercial purposes. if that has not been given, then a complaint in the municipality is to be filed against such use by the person. meanwhile, a complaint can also be made to the police stating the nuisance being created by the person after opening commercial office. Meanwhile an injunction suit can also be filed however that is a long drawn process.

    But the persons here are using the residential property as godowns, as nobody stays in that property. I as a resident of the same street face problems as heavy vehicles generally visit and block road for the residents vehicles to move freely. And as far as safety of my family is concerned, it is at risk as many people from outside visit the street, and many times I have caught people standing upside of the truck and peeping inside my house.

      In that case, a complaint is must to be filed against the owner of the house before the police as the same is violating the norms. the residential house cannot be used as a gowdown for the purpose of storing the articles required to be sold in the house. A permission is required to be taken. the inconvenience being caused needs to be reported to the Municipality as well. Report the same to the Mayor of your Ward as well and at the chief minister window as well.

  1. Except few exempted professional like advocate, Doctor, a residential property cannot be used commercially. You can report misuse of residential property to municipal corporation of area where property is situated. For nuisance you can report to police
